Terms & Conditions
STRETCH YOUR STORY and its affiliates, subsidiaries, and their respective representatives, directors, officers, agents, and employees ("STRETCH YOUR STORY", "Company", "we", "our", or "us") will grant eligible persons an opportunity to participate in its Creator Program, which includes special benefits to members, including access to product discounts and other benefits (the "Creator Program").
Your participation in the STRETCH YOUR STORY Creator Program is CONDITIONED ON YOUR ACCEPTANCE of these terms and conditions. By applying for, participating in, or receiving benefits from the Creator Program, YOU HEREBY AGREE to be legally bound by these terms for good and valuable consideration, including your participation in the Program and receipt of associated benefits.
Member Eligibility and Representations
Member Eligibility and Representations By participating in the STRETCH YOUR STORY Creator Program, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these terms. You must be a qualified yoga instructor, fitness professional, wellness coach, or other eligible professional as determined by STRETCH YOUR STORY in its sole discretion. You further represent that all information provided in your application is true, accurate, and complete, and you agree that any false or misleading information may result in immediate disqualification and forfeiture of all program benefits.
Account Non-Transferability: Your Creator account and all associated benefits are personal to you and may not be transferred, assigned, shared, or used by any third party without our prior written consent.
Geographic Eligibility: This program is available exclusively to residents of the United States. By participating, you represent and warrant that you are a legal resident of the United States and that all program activities will occur within the United States.
Affiliate Program and Commission Structure
Approved Creators will receive access to an affiliate program managed through AWIN ("Affiliate Platform"). Through this program, you may earn commissions on qualifying sales generated through your unique referral code.
Commission Terms:
- Commissions are calculated on the final sale price after any discounts are applied
- Only eligible purchases made through your unique referral code qualify for commission
- Commission rates and payment schedules are determined by the Affiliate Platform's standard terms
- Minimum payout thresholds apply as set by the Affiliate Platform
Affiliate Platform Integration:
- Your participation in the affiliate program is subject to AWIN's terms of service, which are incorporated herein by reference
- Commission payments are processed directly through the Affiliate Platform, and STRETCH YOUR STORY has no control over payment processing, timing, or methods
- You acknowledge and agree that STRETCH YOUR STORY is not responsible for: (i) any delays, failures, or errors in commission payments; (ii) any technical issues, downtime, or malfunctions of the Affiliate Platform; (iii) any disputes between you and AWIN; (iv) any changes to AWIN's terms, commission structures, or policies; (v) any suspension or termination of your affiliate account by AWIN; or (vi) any other issues arising from your use of the Affiliate Platform
- STRETCH YOUR STORY makes no warranties regarding the Affiliate Platform's performance, availability, or reliability
- Any disputes related to affiliate commissions, payments, or platform functionality must be resolved directly with AWIN
Performance Tracking:
- Access to performance data and commission tracking is provided through your affiliate dashboard
- All affiliate-related activities must comply with applicable laws and advertising standards
Tax Responsibilities:
- You are solely responsible for all tax obligations arising from commission payments received through the affiliate program
- STRETCH YOUR STORY will not provide tax advice or assistance with tax filings
- You acknowledge that commission payments may be subject to income tax reporting requirements and agree to consult with a qualified tax professional regarding your obligations
- Any tax forms or documentation required by law will be handled directly between you and the Affiliate Platform
Return/Refund Impact on Commissions:
- If a customer returns merchandise or receives a refund for any purchase made through your referral code, the corresponding commission will be deducted from your future payments or you may be required to repay such commission
- Commission adjustments for returns/refunds will be processed according to the Affiliate Platform's standard procedures
Discount Eligibility
The Partner discount applies to full-priced items only and cannot be combined with other promotions, discounts, or limited-time offers. Discount will be automatically applied at checkout when logged into your registered STRETCH YOUR STORY account.
Promotional Exclusions
The discount cannot be combined with any other promotional codes, campaigns, discounts, or incentives.
Content Usage Rights
As part of your participation in the STRETCH YOUR STORY Partner Program, any photos, videos, written content, or other materials (collectively, "Content") that you voluntarily submit to the company or that are collected by STRETCH YOUR STORY during the course of your participation may be used by the company without limitation.
By participating in the program, you grant STRETCH YOUR STORY and its affiliates a worldwide, perpetual, royalty-free, transferable, and sublicensable license to use, reproduce, edit, adapt, distribute, publish, display, and create derivative works from all or any part of the Content, in any format or medium now known or hereafter developed. This license shall survive termination of your participation in the program. STRETCH YOUR STORY reserves the right, but not the obligation, to use, display, or distribute any Content submitted through the program.
This license also includes the right to use your name, nickname, likeness, social media handle, profile image, and any identifying elements included in or associated with the Content, for any marketing, advertising, promotional, or commercial purpose, whether online, in-store, in print, or through other distribution channels. STRETCH YOUR STORY is not required to provide notice, attribution, or compensation for such use.
You represent and warrant that you hold all necessary rights to the Content, including but not limited to copyrights, trademark rights, publicity rights, and any other proprietary rights. You further warrant that any individuals featured in the materials have given appropriate permission for their image or likeness to be used accordingly, including but not limited to model releases and location permits where applicable. You confirm that the Content does not infringe upon any third-party rights or violate any applicable laws or regulations.
You agree to indemnify, defend, and hold harmless STRETCH YOUR STORY, its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, demands, losses, damages, costs, expenses (including reasonable attorneys' fees), and liabilities arising from or related to: (a) your Content or any use thereof by STRETCH YOUR STORY; (b) any breach of your representations, warranties, or obligations under these terms; (c) any claims by third parties regarding the Content; or (d) any violation of applicable laws in connection with your participation in the program.
Annual Renewal Required
To maintain active Partner status, all members are required to renew their application annually. Renewal reminders will be sent prior to expiration.
Program Termination Rights
STRETCH YOUR STORY reserves the right to suspend or terminate your participation in the Partner Program at any time, with or without notice, for any reason including but not limited to:
- Violation of these terms or applicable laws
- Misuse of the program
- Suspected fraudulent activity, including but not limited to system manipulation, artificial purchase inducement, creation of multiple accounts, or use of unauthorized promotional methods
- Providing false, misleading, or incomplete information in your application or certification documents
- Engaging in conduct that damages STRETCH YOUR STORY's brand reputation, including but not limited to defamatory statements, inappropriate public behavior, or activities that reflect negatively on the company
- Unauthorized transfer, sharing, or assignment of your Partner account to third parties
Upon termination, all program benefits will cease immediately and you will be disqualified from future participation. The Content Usage Rights shall survive termination.
Program Suspension and Discontinuation
STRETCH YOUR STORY reserves the absolute right to suspend, modify, or permanently discontinue the entire Partner Program or any portion thereof at any time without prior notice and for any reason, including but not limited to business considerations, regulatory changes, or operational requirements. In the event of program discontinuation, no compensation or damages will be owed to participants for lost opportunities or benefits.
Program Modifications
STRETCH YOUR STORY reserves the right to modify or update these terms, benefits, or structure of the Partner Program at any time without prior notice. Such modifications will be effective immediately upon posting. Continued participation after such modifications constitutes acceptance of any revised terms. You are responsible for regularly reviewing these terms to stay informed of any changes.
Account Security and Responsibilities
You are solely responsible for maintaining the confidentiality and security of your Partner account credentials. You must immediately notify STRETCH YOUR STORY of any unauthorized use of your account or any other breach of security. STRETCH YOUR STORY will not be liable for any loss or damage arising from unauthorized account access due to your failure to maintain account security.
Intellectual Property and Brand Guidelines
STRETCH YOUR STORY grants you a limited, non-exclusive, non-transferable license to use our trademarks, logos, and brand materials solely for the purpose of promoting STRETCH YOUR STORY products through the Partner Program. This license is revocable at any time and terminates immediately upon program termination. You may not modify, alter, or create derivative works of any STRETCH YOUR STORY intellectual property. All use must comply with our brand guidelines, which may be updated from time to time.
Marketing and Advertising Compliance
All marketing and promotional activities related to the Partner Program must comply with applicable laws and regulations, including but not limited to Federal Trade Commission (FTC) guidelines regarding endorsements and testimonials, CAN-SPAM Act for email marketing, truth in advertising standards, and all applicable consumer protection laws. You must clearly and conspicuously disclose your relationship with STRETCH YOUR STORY and any compensation received when promoting our products. Failure to comply with these requirements may result in immediate termination from the program.
Compliance with Laws
You agree to comply with all applicable federal, state, and local laws and regulations in connection with your participation in the Partner Program. This includes, without limitation, advertising laws, consumer protection laws, privacy laws, and tax laws. You are solely responsible for ensuring your compliance with all applicable legal requirements.
Force Majeure
STRETCH YOUR STORY shall not be liable for any failure or delay in performance under these terms that is due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, labor disputes, pandemics, or technical failures. During such events, STRETCH YOUR STORY may suspend program operations without liability.
No Employment, Agency, or Partnership Relationship
Your participation in the Partner Program does not create any employment, agency, or partnership relationship between you and STRETCH YOUR STORY. You are not authorized to bind or represent STRETCH YOUR STORY in any capacity, and you acknowledge that you are participating as an independent contractor.
Privacy
Your participation in the program is subject to our Privacy Policy, which is incorporated by reference and available at https://www.stretchyourstory.com/policies/privacy-policy. By participating, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRETCH YOUR STORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR PARTICIPATION IN THE PROGRAM, REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER OR NOT STRETCH YOUR STORY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Disclaimer of Warranties
THE PARTNER PROGRAM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Governing Law and Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from or relating to these terms shall be resolved exclusively in the state or federal courts located in New York, New York, and you consent to the personal jurisdiction of such courts.
General Provisions
Severability: If any provision of these terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms & Conditions constitute the entire agreement between you and STRETCH YOUR STORY regarding the Partner Program and supersede all prior or contemporaneous communications and proposals.
Assignment: You may not assign or transfer your rights or obligations under these terms without our prior written consent. STRETCH YOUR STORY may assign these terms at any time without notice.
Waiver: No waiver of any provision of these terms shall be deemed a further or continuing waiver of such provision or any other provision.
